3. Engineering Services and Agreements

All project engagements are governed by a separately executed statement of work, master services agreement, or purchase order. These Terms of Use do not create any service agreement, warranty, or liability on behalf of GSM. Acceptance of a quote does not bind GSM until a written agreement is executed by an authorized GSM representative.

4. Intellectual Property

All design files, drawings, prototypes, software, and technical documentation developed under a GSM engagement remain the property of the client upon full payment, unless otherwise specified in a written agreement. GSM retains the right to identify completed projects in its portfolio unless restricted by a confidentiality agreement.

5. Regulatory and Certification Disclaimers

GSM designs and manufactures products to meet applicable marine regulatory standards including ABYC, ISO, USCG, SOLAS, and flag state requirements where specified. It is the client's responsibility to confirm the regulatory applicability of a product for their vessel type, flag state, and operating area. GSM does not guarantee type approval or flag state acceptance.

6. Limitation of Liability

To the maximum extent permitted by law, GSM shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this website or from product performance outside of agreed specifications. GSM's total liability under any circumstances shall not exceed the amount paid by the client for the specific product or service at issue.

7. Governing Law

These terms are governed by the laws of the State of Wisconsin, USA. Any disputes shall be resolved in the courts of Waukesha County, Wisconsin, and both parties consent to personal jurisdiction in that venue.

8. Changes to These Terms

GSM reserves the right to update these Terms of Use at any time. Updated terms will be posted to this page with a revised effective date. Continued use of the site after changes are posted constitutes acceptance of the new terms.
